6.5. A sales contract is concluded when the Seller confirms acceptance of the order by email or otherwise expressly confirms that the order has been accepted for fulfilment.
6.6. The Seller reserves the right to contact the Customer to clarify order details, availability, vehicle compatibility or delivery arrangements.
6.7. If a Product becomes unavailable after an order has been placed, the Seller will inform the Customer and propose an appropriate solution, including a refund where applicable.

7.1. Products offered in the Store may be:
-
Available from the Seller's stock;
-
Available from a manufacturer's or supplier's stock;
-
Available on special order;
-
Temporarily unavailable.
7.2. Product availability information is indicative and may change due to manufacturer stock levels, supplier availability or logistical circumstances.
7.3. The standard order processing and fulfilment time is between 1 and 14 business days, depending on Product availability, supplier stock levels and whether the Product needs to be ordered or imported from the manufacturer.
7.4. The processing period begins after the order has been accepted and the required payment has been received or confirmed, where advance payment is required.
7.5. The processing time specified in section 7.3 refers to the preparation and dispatch of the order. The actual delivery time may additionally depend on the selected shipping method and destination.
7.6. If the expected processing time is extended for any reason, including supplier delays, manufacturer delays, import procedures or logistical circumstances, the Seller will inform the Customer without undue delay and provide an updated estimated fulfilment date.
7.7. If the revised fulfilment date is not acceptable to the Customer, the Customer may exercise any cancellation, withdrawal or refund rights available under applicable law.
7.8. Estimated lead times for special orders will be communicated to the Customer or displayed in the Store where available.
7.9. Some Products may be ordered specifically for an individual Customer.
7.10. Products imported or ordered from manufacturers specifically in response to a Customer's order are not automatically excluded from statutory return or withdrawal rights.
7.11. The Seller reserves the right to exclude voluntary returns or exchanges beyond the statutory rights of Consumers for special-order Products, where such additional return arrangements are offered.
7.12. The statutory right of withdrawal may be excluded only where a specific statutory exception applies, including Products manufactured according to the Consumer's individual specifications or clearly personalised Products.
7.13. A Product being ordered from a manufacturer or supplier specifically after a Customer places an order does not, by itself, exclude the Consumer's statutory right of withdrawal.
7.14. In B2B transactions, the Seller may agree individual conditions for special-order Products, including restrictions on voluntary cancellation or returns, provided these conditions are communicated to and accepted by the Business Customer before the contract is concluded and are permitted by applicable law.

8.1. Orders are dispatched from Poland.
8.2. The Store may offer delivery to Poland, European Union countries and the United Kingdom, subject to the available shipping options.

8.5. Estimated delivery times are provided during checkout or communicated individually where necessary.
8.6. Unless otherwise agreed, the Seller will deliver Products within the period required by applicable law.
8.7. If no delivery period has been agreed, delivery to Consumers within the EU must generally take place within 30 days of the conclusion of the contract.
8.8. For Consumers, the risk of accidental loss or damage to Products generally transfers upon physical possession of the Products by the Consumer or a third party designated by the Consumer, other than the carrier, subject to applicable law.
8.9. Where the Customer independently selects a carrier not offered by the Seller, the risk may transfer in accordance with applicable mandatory law.
8.10. Business Customers are responsible for checking the condition of delivered packages upon receipt and reporting any visible transport damage to the carrier where appropriate. This does not exclude statutory rights or claims against the Seller.
8.11. International shipments may be subject to customs procedures and additional delivery times.
9. RIGHT OF WITHDRAWAL – CONSUMERS
9.1. Consumers purchasing Products through the Store have the statutory right to withdraw from a distance sales contract within 14 days without providing a reason.
9.2. The withdrawal period begins on the day the Consumer or a third party designated by the Consumer, other than the carrier, takes physical possession of the Product.
9.3. In the case of an order consisting of multiple Products delivered separately, the withdrawal period begins when the last Product is received.
9.4. To exercise the right of withdrawal, the Consumer must inform the Seller of their decision by an unequivocal statement, for example by email to info@armmotorsports.eu.
9.5. The Consumer may use the model withdrawal form provided at the end of these Terms and Conditions, but this is not mandatory.
9.6. The Consumer must return the Product within 14 days of notifying the Seller of the withdrawal.
9.7. The Consumer is responsible for the direct cost of returning the Product, unless otherwise required by applicable law or agreed with the Seller.
9.8. The Consumer may inspect the Product to establish its nature, characteristics and functioning in the same manner as would be permitted in a physical shop.
9.9. The Consumer is responsible for any diminished value of the Product resulting from handling beyond what is necessary to establish its nature, characteristics and functioning.
9.10. Products returned should include all components, accessories and documentation originally supplied, where possible. This does not restrict statutory withdrawal rights.
9.11. Following a valid withdrawal, the Seller will reimburse payments received, including the cost of standard delivery, in accordance with applicable law.
9.12. The Seller may withhold reimbursement until the returned Product has been received or evidence of its return has been provided, whichever occurs first.
9.13. Reimbursement will be made using the original payment method unless otherwise agreed with the Consumer.
9.14. The statutory right of withdrawal does not apply to certain contracts where an exception is provided by law, including:
-
Products manufactured according to the Consumer's individual specifications or clearly personalised Products;
-
Other Products or services expressly excluded by applicable consumer legislation.
9.15. Special-order and imported Products: The fact that a Product is imported, ordered from a manufacturer, purchased from an external supplier or sourced specifically following a Customer's order does not, on its own, exclude the Consumer's statutory right of withdrawal.
9.16. Where a Product has genuinely been manufactured according to the Consumer's individual specifications or has been clearly personalised, the statutory exception to the right of withdrawal may apply.
9.17. Nothing in this section limits any additional withdrawal rights provided by the mandatory laws of the Consumer's country.
10. COMPLAINTS AND STATUTORY PRODUCT CONFORMITY
10.1. The Seller is responsible for ensuring that Products supplied to Consumers conform to the sales contract in accordance with applicable consumer protection legislation.
10.2. Consumers are entitled to statutory remedies where a Product is defective or does not conform to the contract.

10.4. In Poland and other EU countries, the statutory period of liability for non-conformity of new goods is generally two years, subject to applicable national legislation.
10.5. Consumers in the United Kingdom retain their statutory rights under applicable UK consumer protection legislation, including the Consumer Rights Act 2015 where applicable.
10.6. A complaint may be submitted by email to info@armmotorsports.eu.
10.7. The complaint should include:
-
Customer's name and contact details;
-
Order number or proof of purchase;
-
Identification of the Product;
-
Description of the issue;
-
Photographs or other supporting information, if available.
10.8. The Seller may request additional information reasonably necessary to assess the complaint.
10.9. The Seller will respond to Consumer complaints within the statutory period applicable to the relevant transaction.
10.10. The Seller will not charge Consumers for remedies that must be provided free of charge under applicable law.
10.11. Where a Product is damaged due to improper installation, misuse, unauthorised modification or use contrary to the manufacturer's instructions, the Seller may reject a complaint to the extent that the damage is attributable to such circumstances and the applicable law permits.
10.12. The mere installation or use of a Product does not automatically exclude the Consumer's statutory rights.
10.13. This section does not limit any mandatory rights available to Consumers under the laws of their country of residence.
11. MANUFACTURER'S WARRANTY
11.1. Products sold through the Store are covered by a manufacturer's commercial warranty where such warranty is offered by the relevant manufacturer.
11.2. The scope, duration and conditions of a Manufacturer's Warranty are determined by the individual manufacturer.
11.3. Warranty claims may require the presentation of proof of purchase, product identification and supporting documentation.
11.4. The manufacturer may require the Product to be inspected or returned for assessment.
11.5. The Customer should contact the Seller before sending a Product directly to a manufacturer unless the manufacturer expressly provides a different procedure.
11.6. A Manufacturer's Warranty is additional to statutory consumer rights.
11.7. The existence, limitation or refusal of a Manufacturer's Warranty does not exclude or reduce the Seller's statutory responsibility towards Consumers.
12. INSTALLATION AND USE OF PRODUCTS
12.1. Performance and motorsport components should be installed by qualified professionals with appropriate technical knowledge.
12.2. The Customer is responsible for ensuring that Products are installed correctly and in accordance with the manufacturer's instructions.
12.3. The Seller is not responsible for damage caused by incorrect installation, improper use, unauthorised modifications or failure to follow manufacturer instructions, to the extent permitted by applicable law.
12.4. The Customer should verify all relevant technical specifications before installation.
12.5. The Seller recommends retaining original vehicle components where appropriate, particularly where modifications may affect road legality, emissions compliance or vehicle inspection requirements.
12.6. Products should only be used for their intended purpose.
12.7. Nothing in this section excludes liability for defects, misleading product descriptions or other circumstances for which the Seller is legally responsible.
13. BUSINESS CUSTOMERS – B2B SALES

13.5. The Seller's liability towards Business Customers is governed by the applicable provisions of Polish commercial and civil law, subject to mandatory legal restrictions.
13.6. To the extent permitted by law, the Seller is not liable for indirect or consequential business losses, including loss of profit, business interruption or loss of commercial opportunities.
13.7. Nothing in this section excludes liability where such exclusion is prohibited by applicable law, including liability for intentional misconduct.
13.8. Any additional commercial terms agreed individually between the Seller and a Business Customer shall prevail over these Terms and Conditions to the extent of any inconsistency.
13.9. For Products imported or ordered specifically for a Business Customer, the Seller may establish individual cancellation, return and order fulfilment conditions. Such conditions must be communicated and accepted before the order is concluded.
13.10. Unless otherwise agreed, cancellation or return of a special-order Product by a Business Customer requires the Seller's prior written consent.
14. FORCE MAJEURE
14.1. The Seller shall not be responsible for delays or failure to perform obligations caused by circumstances beyond its reasonable control, including natural disasters, war, strikes, government restrictions, customs delays, transport disruptions, supplier interruptions or other extraordinary events.
14.2. The Seller will make reasonable efforts to inform affected Customers and minimise the consequences of such events.
14.3. This section does not remove any mandatory rights of Consumers to cancel a contract or obtain a refund where required by applicable law.

17.5. The European Online Dispute Resolution (ODR) platform is no longer operational and is therefore not referenced in these Terms and Conditions.
